“Nepal New Year” PROMOTION TERMS AND CONDITIONS

  • 1. Information on how to enter and the prizes form part of these terms and conditions. By participating, entrants agree to be bound by these terms and conditions.
  • 2. The promoters of this Promotion are:

  • 3.Entry is open to Nepal residents aged 18 years or above who satisfy the entry requirements outlined in clause 5 below (“Eligible Participants”). Employees (and their immediate families) of the Promoter, Western Union® Agents and Sub-agents, and service providers/marketing agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  • 4. This Promotion commences on 12:01 am (Nepal Time) on 25th March 2024 and ends on 11:59 pm (Nepal Time) on 30th April 2024 (“Promotion Period”) and is subject to extension by Promoter. Entries received after 11:59 pm (Nepal time) on 30th April 2024 (or such later Promotion Period end date stipulated by Promoter) will not be accepted and will be deemed invalid.
  • 5. Campaign Mechanism:
    • 5.1 Customer Eligibility for the campaign:
      Eligible Participants who receive money of any amount via Western Union® services from any Country outside Nepal and paid out in Nepal with a valid Money Transfer Control Number (“MTCN”) during the Promotion Period (“Qualifying Transaction”) will automatically enter in the draws.
      Note: offer applicable only for Cash Payouts in Nepal from participating agent locations. Funds in could be any method. Funds out should be cash only.
    • 5.2 Draw Structure:
      • a. Eligible Participants can enter the draw more than once during the Promotion Period depending on the number of Qualifying Transactions received separately by them every day. An Eligible Participant may win more than once if they have multiple entries across multiple draw dates during the Promotion Period.
      • b. The Promotion period will run from 25th March to 30th April.
      • c. In addition to the Weekly Lucky Draw, there will be one (1) final Bumper Lucky Draw winner in the end of the Promotion period from the Qualifying transactions entered for those 1 (One) month (“Bumper Lucky Draw”)
      • d. There will be a total of 6 (Six) draws. Specifically, two types of draws will be carried out during the Promotional Period, as seen below:
        • i. The first type is the Weekly Lucky Draw: Agent will run a lucky draw campaign every week (for 5 weeks) at their location. Participants who have completed transactions within that week will automatically be entered into the lucky draw. Seven winners will be randomly selected from the eligible participants.
          • Each of the seven winners in the weekly lucky draw will receive amount of Rs. 15,000.
          • For 5 weeks, customers will win the amount of Rs. 15,000 each
        • ii. The second type of draw is the One Big Lucky Draw: In the end of the Promotion Period. All the Qualifying transactions including weekly winning transactions during the Promotion Period will automatically enter the Bumper Lucky Draw.
          • The bumper winner will receive a prize of Rs 100,000.

      The prize number for the Big Lucky draw will be for one lucky draw winner.

      All draws will be held at the Participating agent location.

      Winning amount will be given in cheque method to winner.

  • 6. Eligible Participants may enter the promotion more than once during the Promotion Period if they have a sufficient number of Qualifying Transactions received separately by them. Eligible Participants must retain the original receipt of each Qualifying Transaction.
  • 7. Winners will be identified based on the MTCN Numbers. Prizes must be collected in a partcipating Western Union agent location in Nepal. In order to collect a prize, winners must present their valid government issued photographic identification document as proof of identification together with the Qualifying Transaction details. Verification is at Promoter’s discretion, whose decision is final.
  • 8. The winner(s) shall be responsible for any tax arising for winning the prize. The prizes are provided by a third party provider, subject to their respective terms and conditions as to product warranty. The third party provider will be responsible for any matters arising from or in connection with the prizes, services, and/or information they provide in relation to which Promoter will have no liability whatsoever. Any enquiry or complaint regarding the prizes, services, and/or information should be directed to such third party provider. Promoter will not be held liable to the quality and availability of the prizes, services and information provided by the third party provider, and excludes liability in connection with the Promotion once the winner(s) enjoys any benefit relating to the Promotion of the full extent permitted by law.
  • 9. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Promoter, including but not limited to technical difficulties or failures, unauthorized intervention or fraud, vandalism, power failure, natural disasters, acts of God, civil unrest, strikes, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the control of Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate to give effect so far as reasonably possible to the original intent of this Promotion.
  • 10.Subject to any applicable laws which cannot be excluded, Promoter and its related bodies corporate and agents associated with this Promotion shall not be liable for any loss, damage or injury suffered or sustained by anyone (including, but not limited to, direct or indirect loss, consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this Promotion or any prize provided as part of this Promotion.
  • 11. “Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Entry is conditional on providing this PI. Promoter will also use, and handle PI as set out in its Privacy Statement, which can be viewed at https://www.westernunion.com/us/en/privacy-statement.html. The Privacy Statement also contains information about how participants may opt out, access, update or correct their PI, and how participants may complain about a breach of their privacy or any other applicable law and how those complaints will be dealt with. Promoter will not disclose participant’s personal information to any entity outside of the country in which it was originally collected. A request to access, update or correct any private information should be directed to Promoter.”
  • 12.Acceptance of any prize, benefit and/or offer provided by Promoter will be deemed as consent by the winner(s) to take part in any related publicity and using their name, likeness, image and/or voice for advertising and other promotional purposes without compensation, except as otherwise prohibited by any applicable law.
  • 13.To the extent that there is any inconsistency between these terms and conditions and other marketing materials or collateral produced in relation to this Promotion, these terms and conditions will prevail.
